ark L. Mahan is Of Counsel at Cherny & Podolsky, PLLC.

Mr. Mahan is a relentless litigator who provides the same intense, zealous advocacy to all his clients. He has a diverse background in law practice, currently focusing his practice on all areas of personal injury law, including construction litigation, litigating catastrophic construction site accident cases under the New York Labor Law. He has spent the vast majority of the last decade litigating cases throughout the five boroughs of New York City, surrounding metropolitan area and beyond. Mr. Mahan is a member of the Trial Practice group.

Following law school, Mr. Mahan served as the law clerk for the Honorable Darlene J. Pereksta in the New Jersey Mercer County Superior Court Law Division Civil Part. At the completion of his clerkship, he began his career working as a litigator. Prior to becoming primarily a plaintiff’s attorney, Mr. Mahan spent several years as a defense attorney at multiple national defense firms. His extensive experience both defending and prosecuting claims has resulted in a fully-developed, complete understanding of a case.

Mr. Mahan’s background includes broad experience in construction, having served as a foreman for a general contractor while pursuing his undergraduate degree at night. This experience provides a natural foundation for his construction law practice based on firsthand knowledge. Mr. Mahan also served as a U.S. Marine following high school, helping to forge the mettle responsible for his success in the legal world.


Mr. Mahan received his Juris Doctor from Rutgers School of Law, where he was a recipient of the Case Scholarship and The Herbert M. and Maxine Ellend Scholarship. At Rutgers, Mr. Mahan was an editor of the school’s flagship publication, the Rutgers Law Review, as well as a Teaching Associate for the Rutgers Legal Research and Writing Program. Also during law school, Mr. Mahan held a legal externship with the Honorable F. Michael Giles (Ret.) in the New Jersey Essex County Superior Court Law Division Civil Part. Included in Mr. Mahan’s legal studies was a semester studying international law at Leiden University in the Netherlands. He received his bachelor’s degree, magna cum laude, in philosophy– completing it in four years while working full time.
